I know for a license you have to have 3 breeding females. My question is do you have to wait until the gliders are proven breeders or do they just count if you have them even if they have not produced yet?

3 females capable of breeding means (in our area) three females with males with the intent to breed them. If you have a females with neutered males you do not need licensing, but if you put male and female 8 week old joeys together with the intent to breed them down the road, you need licensing.
Again, you need three females that fall within those guidelines. It's best to check with your region if you have questions though. Interpretation of the law is different everywhere. It's good to know what your own area requires.

If you have MORE than three BREEDING females and are SELLING the offspring, you need a license.
If you are not selling the offspring, it doesn't matter how many gliders you have.

As mentioned above, the interpretation of the law differs. Some states won't even look at you twice until you are selling joeys, while other states will give licenses with fewer females. My inspector was happy to give me my license when I had 3 breeding females and 3 more young pairs that weren't even close to breeding. My inspector also counts females that are in the house towards the number, as hypothetically, I could decide to breed them or an accident could happen (not at MY house, lol). And, I wanted to comment that the person who has ONLY females... they are not capable of breeding... in order to breed, a male must be present, so you can get around it since they wouldn't be technically able to breed (at your house). The main purposes (that I see) of the USDA license is to tax breeders, and make sure that the animals are kept in appropriate situations (to try to prevent mill breeders).

I agree, it is a way to tax breeders but as for trying to prevent mill breeders? NOPE. The mill breeders ARE USDA licensed. The USDA standards are so low they allow gliders to be kept in 1 foot cubes. The cage ONLY has to be large enough for the animal to stand up and turn around. USDA License requirements For a Class A breeder license. Class B license is for brokers. A dealer with a Class A license may conduct business involving: [1.1] C only animals that are bred and raised on his/her premises in a closed or stable colony, and C animals acquired for the sole purpose of maintaining or enhancing the breeding colony
NOTE: Persons with 3 or less breeding females are exempt.
selling of any wild/exotic animals, excluding hoofstock, for: < pets < exhibition < research The law as written is BREEDING, not BREEDABLE. While different inspectors may wish to interpret it differently, ultimately they must follow the way it is written or get the "written" part changed. Until that happens, females have to be breeding to be counted.

USDA is federal so any legal state. Some states it is illegal to even have gliders.

Each state has their own laws as well. Some states such as Florida also requires you to have a permit (or license or some such) if you are breeding/selling.

From my understanding, if there are more than 3 females in your home now either breeding or you are holding in the attempt to breed, you need a USDA license. That is Federal.
You also need to check your local laws as well.
Here in Iowa, even if you have only one female breeding, they require you have a state license which costs $175 per year. They also count, dogs, cats, hamsters and anything else that may be breeding in your home. Not just one species.
