Well, this is not the end but it does show that the PGC may not have all the rights that they think they do.

Now Sandy needs to get the animals back that are still alive and sue the PGC for the one that did not make it in their hands!

Sandy has been found not guilty of all charges against her in District Court
in front of the Judge. The State could not prove that her animals were
exotic or wild. The judge ruled that her animals were not mentioned in
Title 34, so she could not be charged with anything under the stature.
This is just the first victory. And hopefully there will be many more to come.

[:"teal"]May I just respectfully say that the PGC does have authority to confiscate animals deemed illegal according to the laws. If some of these laws are contradictory or outdated-(which is highly probable, as noted in previous discussions, ad naseum, I might add!) then the court will sort them out accordingly. Ignorance of the law is certainly not a plausible excuse and previous posts have indicated that the person in question has clearly ignored numerous laws with respect to some of the species confiscated. Highly doubtful that she'll prevail against the state or PGC. She may have won a small battle, but I'm certain that the state or local authorities will prevail in the overall war. Those who live in the state may wish that all of the "hoopla" hadn't been initiated when all is said and done! Just one man's opinion on the issue! <img src="/ubbthreads/images/graemlins/smile.gif" alt="" />[/]

I do agree that it was a small battle won for her in her state and that she did not abide by some laws but from all of the things that I have been sent from that state there are a lot of things that the PGC does not do right. Although some things were not on the up and up, she did have a license for most of the animals.

As far as the "hoopla" goes this is going on all over the United States now (trying to ban exotics) and I personally think there are going to be a lot of us out here wishing things never came to light on this subject. And your opinion is greatly respected!

My opinion is that we have to start somewhere, and why not here. We people as a group, have more power then the government, if the whole decided to not follow the government, would they through us all in jail? no, because then the country would fail, they depend on us, and us being happy, all it takes really is enough of the population to speak up. The problem with what has been happening, is that people keep attacking this problem alone, or in small group, where as we would have a larger affect if we did it as a whole, i also believe highly in the value of using media to your advantage, and gaining the support of the general population.

Sandy's case is one victory, one of hopefully many to come, it takes time to change things, but if no one ever fought for change, then we might as well be prisoners in our own homes.

Im sure that that the PGC has changed their laws or is getting a better lawyer because of this case. This might be an invitation for people to get their gliders "grandfatered" but it could be risky.

Exotic Animal Breeder Cleared

I agree that the states and the game departments have a right to protect themselves from animals deemed dangerous for what ever reason.

What I do not agree with is the way that this case was handled by the person in charge. It is clear to me that this guy was just out on a power trip.

Please, showing up with armed agents, and allowing animals to die or get ill within the system that they created to protect the same animals that they take into custody. Hmmmm I don't know but there is something wrong wtih the system.

Whats next? armed agents come to your house from DCF to take your children because you either smoke, or drink, or feed them foods that can cause children to get obese? I know it may not be the same, but I feel that its time, time for people to stand up and realize that the goverment was created by the people, for the people, and of the people. Not vice versa!

I just want to respectfully point out that the Pennsylvania court has already ruled that the animals confiscated by the PGC were not illegal. Incidently, does anyone know what the current status of the lawsuit that the ACLU is considering to file against the PGC?
