Dawnie, considering the damage the little guy suffered, and the attempted cover up, I'd think you wouldn't have to honor a replacement-contract or no. There is no excuse for abuse/neglect of medical needs (which not taking an injured animal to a vet is illegal in some states and even carries jail time). With the vet to back you as to the extent of the injuries, I believe the court would support you if they cared to take it that far. It's horrible to think someone would do this to an animal, wait on medical treatment, and then lie about it. IMHO-that kind of person should be taken out and shot. (sorry, it's how I feel). If they ask for a refund, give it Minus the vet bills. I feel so bad about this, and for you and your family! <img src="/ubbthreads/images/graemlins/upset.gif" alt="" />

such a sad sad story,my heart goes out to you.
I think with the fact that they did not seek medical attention but returned him to u and wouldn't tell you what happened to him,not only delayed possible treatment and pain therapy he could have had but this is also morally wrong. Contract wise,if you had one this could equal a breech. Regardless of that becuase of hiding it,even if it was an accident that makes it so much more wrong and seemingly puts it more under cruelty rather then accidental as far as animal rights go.I think,though it may be difficult they should be reported for what they have done,they need to learn a harsh lesson in this I think.
Your poor baby joey,I am so sorry for you and it.
Under no circumstances what so ever do to the obvious and proven injuries of either accident or intent,but inuries non the less you are under absolutely no obligation to return a single cent or replace the joey,you have the right to refuse to do that becuase they hurt it.
Only if the joey died of illness or of no explanation within your garantee period would u be required to do that.
I would choose not to give them another glider or money and would report them for what they did especially becuase they hid it from you.With the fact that there has been xrays etc you have proof of this cruelty to back up your side.
Again I am so sorry you have had to go through this and loose this little guy like this,its so heart breaking.

we all try our best to screen... and every once in awhile one slips through our fingers .. i've had it happen to me once too and it was horrible...

however, since they were dishonest they violated the contract and therefore they don't have to be able to get another glider.

this makes me ill

Dawnie, You did the best you could screening, as has already been said, sometimes people get by us, no matter how hard we try to screen them! I've had a few myself, luckily they were this serious, but could have been. The only way to prevent this from EVER happening is to not sell gliders or place gliders period. That would be really sad for all those out there that could and would provide a wonderful home. Don't blame yourself, you did all you could. I would also think that they would have to have upheld their end of the contract to for you to. Usually if an animal is mistreated and that causes death, that voids the replacement clause, that is only there if it's something you are responsible for. I only guarantee that the glider is healthy when it leaves my home, because I don't know what happens after it's out my door. If they can prove it's a health issue that I should have known about, that's different, but rare.
