PA legal 2012 (I may have discovered something!)

PA legal 2012 (I may have discovered something!) - 01/28/12 03:33 AM

I just found this article on craigslist about exotic wildlife in Pennsylvania. In the section that defines exotic wildlife they also include animals that are not considered exotic wildlife such as birds, ferrets, guinea pigs, rabbits, rats, mice, etc. BUT also in this section they have sugar gliders and hedgehogs. Does that mean they are now no longer considered exotic wildlife? Here's the link along with some quotes.

Quote:

The term shall not be construed to include any member of the
26
class Aves (birds), any member of the families Equidae (horses,
27
[censored] and zebras), Camelidae (camels, alpacas and llamas),
28
Cervidae (deer, moose and elk), Bovidae (wild cattle and spiral-
29
horned antelopes), Muridae (rats and mice), Chinchillidae
30
(chinchillas and viscachas), Leporidae (rabbits and hares),
20110HB1398PN1967
- 2 -

1
Erinaceidae (hedgehogs and moonrats), Petauridae (gliders and
2
striped possums) or any member of the species Mustela furo
3
(domestic ferrets) or Cavia porcellus (domestic guinea pigs).

I need people that are more experienced with these things to read this for me and tell me what they think. This really could be our proof they are legal!

I don't believe the issue was because sugargliders were considered "wildlife". The problem is they say you can own them *IF* you get a permit. However they are no longer issuing any permits. Therefore they are illegal to own.

Not to mention, IMO craigslist is not a reliable reference. I would not trust them.

Re: PA legal 2012 (I may have discovered something!) - 01/28/12 03:46 AM

But the only reason you needed a permit in the first place was because they are exotic wildlife and you needed an exotic possession permit which in PA is almost impossible to get.

And it's not a craigslist ad, someone posted a link to this house bill on there.

Because the USDA, which is Federal, considers them Exotic, no State can call them less. The state must meet or exceed the federal level.

Okay I see what you're trying to say but I thought that only applied to breeding? I found this article about hedgehog ownership and 5th grade kids fighting for them to pass this bill (the one I'm talking about) so it will redefine the term exotic wildlife thus making them legal in PA. Here is the article: http://articles.mcall.com/2011-06-26/fea...pet-wrong-state

The best thing would be to contact the officials in PA and/or an attorney and ask them. We can only give our best guess, same as you.

Looking over that more. That is a "bill" put before the state. It doesn't state IF it was approved or not. IF it was approved, then they no longer consider gliders "exotic wildlife".

My hubby works for an attorney and he said he'll ask if we are reading that correctly. But he can't do that until Monday.

Well in that case I found this...
Which says:
Quote:
"Last Action: Third consideration and final passage on Jan 24, 2012"

So what do you think ?

I would contact one of the legislators authoring this bill and see if it was passed.

The blue portion of this quote is animals that are going to be exempted after this bill is passed. Thereby making it legal to have sugar gliders as pets without a permit.

I was told by Adam at the SGGA last year that this legislation was in the works in Pennsylvania and to watch for it to be passed.

Dancing, did you talk to your husband about what he thought? Has anyone contacted someone to find out if this Bill passed and made gliders legal.
Seems like someone said they ARE legal as of 60 days after 1/24/2012 and it has been spreading over facebook. I would hate to see people rush out and get gliders because they saw someone said on FB that they were legal. I would like more proof..

The bill passed the PA Senate unanimously. It still has to make its way through the House and still must be signed by the Governor.

The Bill is PA HB1398 if you want to keep up on it.

Has anyone checked on this?
When I looked at the board on it, it looked like it passed through all three criterion? (Only curious because my mom lives in PA).
She has started asking about my fuzzbutts =]

It's been stalled since May. It got through the House okay, but it hasn't budged since it got to the Senate 4 months ago. And since they only have until November to get it through the Senate and approved by the governor, I personally am highly doubtful it will go through. It's been in the Senate since January, and it's gone exactly nowhere.
