http://assembly.state.ny.us/leg/?bn=S07616&sh=tThis bill has just passed senate and assembly and will take effect in January 2005. As of a few weeks ago, the text of this bill had a whole section listing exotic animals which were to be considered "companion" animals and thereby exempt from this bill--including sugar gliders. That section is no longer there. NY glider owners: find out who your assembly members are and contact them, you can search by zip code here: http://assembly.state.ny.us/mem/

oh wow.. so this affects the whole state of NY... do they have a grandfather clause
edit: okay it seems they do have one if you apply within 60 days of the effective date... now does that mean that if you apply you can still breed or not? anyone know?

Oh no! Don't tell me I have to move just to keep my gliders. I sure hope they are on the safe list. I tried to read through some of that but it is very confusing. I will have to contact my assemblymen and see what he says.

If you read the text of the bill, yes, there is a grandfather clause, but among other requirements, you cannot breed them.

I just emailed my assembly men and I hope to hear something soon about it or I may call the office Monday morning. My hubby and I have been thinking of moving to Maine anyhow and this just may be the fire to put under out butts and move there. I will let you know what I find out.

I'm so sorry they are doing this. The reason is "monkey pox" and the FDA would love nothing more than to ban all exotics. I wish there was something that could be done but many prairie dog owners/ breeders have been working very had to lift the ban and so far nothing. Now there may be exemption for placing gliders but it would only apply in the same state. This really is awful, right now NY but how many others will join.

It sounds like they are going after the reptile/ crocidilian species and Large exotics. Whithin the past year, we had a guy not to far from me with two alligators in his back yard. They were were babies but they were 4 feet long and they got lose. One was found immediately and the other took almost 2 months to find. We also had someone with an african servle get out his basement window and ran around for a week in a populated community. Than there was the man in manhattan 4 months ago living with 6 monkeys. All of the people with these large exotics and venomous are required to get a permit like the gliders, but they don't. Pennslyvania has these shows were you get any type of reptile/venomous and you dont need a permit to sell or buy. I think they need to regulate that first and see if it stops. It wont stop it all but might slow it down. Usda gives you a permit and see you later all it is is paperwork signed and mailed back to you with or without a liscense. They dont even check up, the are supposed to, but i worked with venomous snakes for about 2 years and not once see the usda do a check. And the office was a block away!! Yes it is a time consuming job to keep track of all exotis in a state. Lets hope they aren't for gliders!!!

The prairie dog people have really been fighting this issue for the past year. Monkeypox issue just made things so much worse so now a lot of counties, etc.. are trying to ban all exotics. PD's have been banned for some time now and that means that these poor guys are getting killed instead of saved and put into good caring homes. Some people (including us) had to keep a lot of pups they had for sale and that means that we have to try and give all these little guys the attention they deserve and that is hard when there are so many and I was lucky to only have 7 left. It's a lot of mouths to feed as well. Some people had over 150 pups to take care of and they are suppose to keep them for life at this point anyway.I don't mind too much as I love them and they are doing fine here, but they would do better with one on one attention. I now have 15 as I had 8 of my own before and that is alot of pd's to play with every day. These laws are going to start affecting a lot of people with a lot of different exotics everywhere so please watch out and speak up now before it's you and your animals. It's just a matter of who is next at this point.

well i am in ny, and i am going to do what i can...i am licensed and i am going to give them a call, and find out any info i can. im not giving my gliders up either way. it seems more like the bigger animals that its focusing on, like gliderdad said, but unfortuantley it most likely affects all exotics, because people caint get a permit, or take proper care of thier exotic pet(s.

WAIT -- it says that the companion animals are detailed in another (apparently already existing law) -- so I don't think this applies to gliders. I'll try to find out. I've been following this bill for some time, and remember seeing the list of companion pets. But I THINK they just removed the LIST from the bill, but it would apparently still stand that gliders are companion animals.

Jelly Bean, it's not a law yet. In most parts of the state, gliders are still legal.
EVEN IF this is true and they've been taken off the companion animals list (and in the current reading of the bill, it doesn't appear this has happened), there are still two steps before this becomes law...it has to pass the state senate again, and has to be signed by the governor.
Please don't jump to conclusions about this until we know for sure they've been removed from companion animal status.

Please read the wording carefully regarding what is being considered a wild animal:

Quote:
21 WILD ANIMAL INCLUDES, AND IS LIMITED TO, ANY OR ALL OF THE FOLLOWING ORDERS AND FAMILIES: 23 (1) NONHUMAN PRIMATES AND PROSIMIANS, 24 (2) FELIDAE (WITH THE EXCEPTION OF DOMESTICATED AND FERAL CATS, WHICH 25 SHALL MEAN DOMESTICATED CATS THAT WERE FORMERLY OWNED AND THAT HAVE BEEN 26 ABANDONED AND THAT ARE NO LONGER SOCIALIZED, AS WELL AS OFFSPRING OF 27 SUCH CATS), AND HYBRIDS THEREOF, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets { } is old law to be omitted. LBD04272-19-4 S. 7616 2 1 (3) CANIDAE (WITH THE EXCEPTION OF DOMESTICATED DOGS), 2 (4) URSIDAE, 3 (5) ALL REPTILES THAT ARE VENOMOUS BY NATURE, PURSUANT TO DEPARTMENT 4 REGULATION, AND THE FOLLOWING SPECIES AND FAMILIES: BOIDAE FAMILY, 5 ASIATIC (WATER) MONITOR (V. SALVATOR), NILE MONITOR (V. NILOCITUS), 6 WHITE THROAT MONITOR (V. ALBIGULARUS), BLACK THROAT MONITOR (V. ALBIGU- 7 LARUS IONIDES) AND CROCODILE MONITOR (V. SALVADORI) AND ANY HYBRID THER- 8 EOF, 9 (6) CROCODILIA.

As you will note only certain Families/Orders are being considered wild aniamls for banning purposes. The taxonomic classification regarding sugar gliders is as follows:

Quote:
Class: Mammalia Subclass: Marsupialia Order: Diprotodontia Superfamily: Petauroidea Family: Petauridae

As you can see, by Class, Order & Family, the sugar glider is not included in the ban. The state's effort is to get large dangerous/venonmous wild animals out of the general public's hands. As for the definition of Companion Animal as defined in SECTION THREE HUNDRED FIFTY OF THE AGRICULTURE AND MARKETS LAW, it has not yet been updated online. I shall attempt to find out if the listing of companion pets still includes sugar gliders and let people know. In the meantime, let all NYS glider owners take a deep breath and calm down as only very specific Orders/Families of wild animals are being banned and as previously stated, gliders are not among those Orders/Families.

OK, cancel the panic. I spoke with my contact in Albany (who remembered me well--I'm not sure if this is a compliment) this morning, who gently pointed out that yes, the entire section defining "companion animals" was removed, because the wording in section 2 was changed to simplify the whole thing by limiting what they're banning. Read carefully just the first sentence Glideroo quoted. It USED to say "...includes and is not limited to..." but NOW says "includes and is limited to..." The removal of that tiny little word "not" makes a HUGE difference. As it stands, anything not specifically listed is legal. Sugar gliders are and will remain legal in New York State (except for NYC.) [OT--Fennec foxes, a member of Canidae, were also on that original list of companion animals, and will be listed as exceptions in the amendment, which is already being written--such is our government.] This bill is actually a good thing. I think that if you have to take precautions to keep it from killing you, it's not a pet, it's a prisoner.

Wow I am glad that that does not apply to gliders. I just made a major investment in my breeding programs with the addition of some hets. It would have been a shame for me to have to mave out of state to breed them.
Please keep me updated on any new information concerning this or any other bill effecting sugar gliders. I would love to help any way possible.

problem i see with the banning of exotics especially small exotics like ferrets and suggiez. When you cant do it in the open you do it in the backroom and i feel it is just making the situation worse. Of course a lot of breeders are licenced but what of the army of smaller hobby breeders that arent im sure as some people base there entire household income on breeding exotics and selling them that it would be hard if not impossible for them to stop, and just as the internet has opened up mail order steroids, what would stop people from going illigit on the net and selling animals from a mobil location i.e. a van? i just think that it is/would be a terrible idea to ban our lil suggiez when for the most part they live there lifes in very close contact with there mumz/dadz and have lil chance of interacting with other animals outside of there homes

I support tougher regulation of exotics especially the dangerous ones that are a threat to the public if mismanaged. This would include venomous snakes, big cats, large mammals and marsupials, and any other venomous animals. I do not support the termination of the rights of breeders not to own smaller less formidable animals like ferrets, sugar gliders, and hedgehogs. Legislation is enacted to protect the public by politicians that may not know the entire background of the animals effected by the ban. That is why it is up to lobbyists to inform them about the effects of such legislative enactment upon the effected population. The best way to get a politician to listen to you is to register to vote and to get a group of registered voters to mail letters and meet in person with the politician. Let the politician know how you would be effected by the passage of such legislation and that you comprise a larger population of voters who would be effected in the same manner. When groups of voters unite they can affect a significant change in policy. Ushuaia

with respect to the NYS environmental conservation law [in relation to prohibiting the possession of wild animals as pets in New York state], it already passed but as I stated above, it is limited to certain orders/families of wild/exotic animals. Even then, there is a grandfather clause which will allow those who already owned such animals to continue owning them subject to special permit and other guidelines being met. The new guidelines are less stringent than the original guidelines proposed almost two years ago. The prior guidelines included a mandate that liability insurance of at least $100,000.00 be obtained by owners, that you had to conspicuously post a sign on your property that you owned a dangerous wild/exotic animal and that owners of banned animals had to notify the city/town they lived in that they had a banned wild/exotic animal per special permit and then the city/town had to notify local police, fire and rescue squad of your name and address in case local police, fire or rescue squad personnel were ever called to your residence. These guidelines no longer appear under the amendment and the guidelines are less difficult to comply with than the guidelines originally proposed. The bad news is that originally, you would have only had to pay $50.00 per each wild/exotic animal. Now it appears the cost will be $80.00 per wild/exotic animal. Guess the state just found a way to generate more revenue for itself.

Just a reminder again, that this new ban did NOT include sugar gliders. They were on a list of animals NOT included in the ban.

I realize that this thread is old but I just got to it now. Anyways, at the beginning of next summer I am moving to NY so I need to know all I can about this topic while it is changing so I appreciate all the information that is passed through here. This is what I am unclear on: Do you have to have a permit to own suggies in NY the whole state or just in NYC? How does one go about getting a permit and can this actually work against you to identify you as an exotics owner? Also, did someone ever find out if sugar gliders were protected under another law? I am not going to give up my gliders but I don't want to endanger them in any way either. Any info helps, thanks!

x0Trinity_Paradise0x: please be aware that although we only know for sure that gliders are illegal in NYC/its burroughs, there can always be a chance that the city/town/county you live in may have a ban on gliders. Therefore, prior to getting a glider, you should contact the town/city/county where you reside in order to be sure they do not have a local ban in existence with respect to gliders and/or other exotics.

Does anyone know if this is still true that gliders are illegal in NYC? Can you lead me in the right direction to find out? Thanks!
